"Rajya Sabha Passes Birth-Death Bill 2026: Court Approval Needed If Registration Delayed Beyond 2 Years"

NEW DELHI:The Rajya Sabha on Tuesday passed the Birth and Death Registration (Amendment) Bill, 2026 by voice vote.

KEY PROVISIONS OF THE BILL:

The amendment aims to modernize and digitalize the registration of births and deaths across India.

If birth registration is delayed beyond 2 years of birth, then parents/guardians will have to go to a Magistrate/Court to get approval before the birth can be registered.

How the new rule works:

Within 1 year: Can be registered at local registrar with standard proof  no penalty

Between 1 to 2 years: Can be registered with late fee + written explanation to registrar .After 2 years:Magistrate/Court order is mandatory + police verification may be required .This "2-year court rule" has been part of the original 1969 Act and the 2026 Amendment keeps it. The goal is to prevent fake/backdated entries.

What else the Bill passed today does:

 Makes birth certificate the single document for Aadhaar, school admission, passport, voter ID, govt jobs

Creates National and State-level digital database linked across departments

Makes hospitals and local bodies mandatorily report births/deaths within 21 days

So the bill passed in Rajya Sabha today, 4th August 2026 by voice vote, but the court requirement for >2 year delay remains unchanged.

Major highlights:

Single National Database: Birth and death records will be linked to a central portal for easy verification

Birth Certificate as Universal ID: Birth certificates issued under this Act will be accepted as proof for admission to schools, government jobs, Aadhaar, voter ID, passport, and marriage registration

Mandatory Reporting: Hospitals, medical institutions and local authorities must report births and deaths within a specified time frame

Digital Integration: Data will be shared with other government departments to reduce duplication and fraud.

GOVERNMENT'S STAND:

The government said the bill will help in better planning, policy making, and delivery of welfare schemes. It will also curb fake documents and ensure every citizen has authentic proof of birth and death.The bill was earlier passed in the Lok Sabha and now goes for Presidential assent before becoming law.
