New Delhi, “Apni raksha khud kare, kisi ke bachane ki pratiksha na kare” With rising concerns over street crime and organized violence, legal experts are urging citizens to know their *Right to Private Defence under the new Bharatiya Nyaya Sanhita (BNS), 2023, which replaced the IPC.
What the law says: Sections 34 to 44 of BNS, 2023 give every citizen the legal right to protect their own and others’ *life and property. Any act done in private defence is *not an offence.
Key sections on self-defence:.
Section 34: No act is an offence if done in exercise of the right of private defence.
2Section 35: Every person has the right to defend their own or any other person’s body, and movable or immovable property.
Section 36: Right exists even against attacks by persons of unsound mind, minors, or intoxicated persons.
Section 37 Only necessary and reasonable force can be used to prevent the danger. Excessive force is not protected.
Section 38: In extreme cases like murder, rape, grievous hurt, kidnapping, or wrongful confinement, causing the attacker’s death is legally allowed.
Section 39: If the attack is not life-threatening, you can cause harm other than deathto the attacker.
Section 40: Right begins when there is reasonable apprehension of danger and lasts till the threat continues.
Section 44: If innocent bystanders risk harm while you defend against a deadly assault, your right of private defence still applies.
Important restrictions:
No retaliation: The law is for defence, not revenge.
Duty to seek help: If there is time to get police/public authority help, you must use that option before using force.
Legal experts say: _“BNS makes it clear — citizens don’t need to wait to become victims. But force must be proportionate. Your action should stop once the threat is gone.”.
With viral videos of organized attacks by goons, awareness of Sections 34-44 can save lives. Police officers confirm that many citizens don’t file cases fearing legal trouble, not knowing BNS protects them.
